This airport has two asphalt runways; one is 3,200 meters and one is 2,750 meters long. It saw 19 million passengers and 141,313 aircraft movements in 2018. It also processed 2,768 tons of cargo. It has three passenger terminals and one cargo terminal. It serves seasonal travelers from places like Guernsey, Edinburgh and Abu Dhabi, as well as scheduled flights from Paris, Vienna and more.

Did you know that if you live outside the European Union, the purchases you make and that you want to take back to your home country are tax-free? Discover how to claim a VAT refund on your purchases in Spain.

What is tax free?

VAT or value added tax is an indirect tax on the final consumption of products and services in countries in the European Union (EU). All visitors whose main residence is outside the EU can claim a tax refund on occasional purchases made in Spain of items for personal use or as gifts which they wish to take back to their country (with the exception of purchases made in the Canary Islands, Ceuta and Melilla).

When and where can you request it?

You must apply for a VAT refund on your purchases at the airport or port of departure from the European Union with the goods purchased, within a maximum period of three months after the purchase.

What documents do you need to claim a VAT refund on your purchases from Spain?

You just have to request the invoice and the electronic tax-free refund document (DER/DIVA form) at the time of purchase, in addition to proving your identity and your residence outside the European Union.

Once at the airport or port of departure, when you are going to return to leave Spain, you must take the electronic tax-free refund documents (DER/DIVA form) with you to validate at the DIVA kiosks or interactive stands, or, where applicable, at the customs office. It is also essential that you bring the purchase invoices, passport, boarding pass and the goods for which you are requesting a refund.

We recommend that you arrive well in advance so that you can make the necessary arrangements and return home with complete peace of mind.

How can you request a VAT refund?

Once the electronic validation process of the tax-free refund documents (DER/DIVA forms) has been completed, you can claim the money. You have two options: Request a VAT refund directly from the shop where you made the purchases, or through tax free management entities authorised by the Spanish Tax Agency (AEAT), which you will find in the boarding areas.

- If you choose to request it directly through the shop: they will refund the entire amount within 15 days by cheque, bank transfer, or to your credit card or other refund method. To do this, you must send the DER visa to the retailer. You have a period of four years to claim it. Once this period has elapsed, the retailer does not have the obligation to return the VAT.

- If you choose to process the refund through the authorised tax-free collaborating entity: they will pay you the corresponding amount of VAT less the authorised fee. The refund may be in cash (in euros), to your credit card, by cheque, or by bank transfer.

For example, the El Corte Ingles department stores in Malaga and Marbella are great for perfumes, aftershaves, fashion, makeup, etc. Especially if you are eligible for a 10% discount with your passport – it’s worth asking them for details. What about paying taxes / duty-free shopping?

If you are travelling within EU countries , you do not have to pay tax or duty if the following applies:  

  • You can transport the goods yourself
  • You will use them yourself or give them as a gift
  • You have paid duty and tax in the country where you bought them

Goods which are not used or consumed on your trip will qualify – think fashion items, cosmetics, jewellery, technology and yes, your wine too. On the other hand, restaurant bills, hotel bills, train tickets, gas bills or alcohol you've already drunk will not qualify. If you're planning to stay in the EU for a bit longer, also make sure you keep an eye on your purchase time, as the right to claim a VAT refund expires at the end of 3 months after the date of your purchase. For example, if you are leaving in April (anytime between 1st - 30th April), the earliest date you can make a purchase and reclaim IVA on it is 1st January.

How to Reclaim IVA

For once with Spanish bureaucracy, the reclaim procedure is not rocket science.

To claim a refund of IVA on purchases made in Spain, you need to fill in a tax-free form (the DIVA form) in the shops where you buy your purchases. This document lists all the items you want to claim an IVA refund on.

This form needs to be validated at customs within three months of the purchase date. Some stores, including El Corte Inglés, offer an electronic IVA refund procedure (DIVA). These forms can be validated directly at automatic terminals installed in Spain’s main ports and airports. If there is no DIVA terminal, the document needs to be validated by a Spanish customs officer. In Andalucia, there are DIVA terminals at Malaga airport and the ports of Algeciras and Tarifa.

As for paper forms, these must be validated by customs officials before you leave the EU. If your form is not validated, the goods will be considered as not having left the EU, and therefore, not eligible for a tax refund.

If you are departing to another country in the EU, you will not be able to reclaim IVA in Spain. You will have to do this in the last customs point before leaving the EU.

There are two ways to reclaim IVA after getting the form validated at Customs:

- Directly through the shop where you made the purchases. They will refund the entire amount within 15 days by cheque, bank transfer, or to your credit card. Basically, you have to post the DIVA forms back to the shop unless the purchase is made at a shop at the airport. - Through the Tax Free management body located where you are departing (a fee will be charged). The refund will be in euros, in cash, to your credit card, by cheque, or by bank transfer.

Let's see below the whole truth about duty free shops and what you will find in them both at Malaga airport and in other countries.

Difference between duty free and tax free

Duty is paid for imported goods and both in Malaga and Spain you must show the boarding pass before making your purchase. For it to be a duty free purchase your destination must be outside the European Union, this applies to purchases of cigarettes, tobacco and some drinks. Remember that there are limits for alcohol, tobacco and cash.

Tax free means that the purchase is tax-free (21% in Spain), a measure that applies to passengers flying outside the European Union, but that also applies to shops belonging to the World Duty Free chain for passengers flying within the EU. The products that usually receive this type of benefits are perfumes, cosmetics, handbags, watches and jewellery or even sunglasses.

For those with a non EU passport there is also the possibility of making purchases from shops outside the airport and receive a refund of part of the VAT. The store must provide with this option to the customer otherwise you will not be able to get the refund later. Request a form which needs to be filled and delivered at the airport before departure.

In which items do you save?

When you travel you realize how expensive everything is in the airports, a simple drink can make your pocket feel bad, so it's no wonder that tourists don't trust the word' duty free'. Let's see what products you will really notice a significant saving compared to buying it outside the airport:

  • Jewellery and watches: Luxury items usually have significant discounts, some airports are cheaper than others so it is best to know its original price before buying.
  • Liqueurs: The taxes for alcoholic beverages are usually high, so you will save money by buying these items at the airport. Most regional tourist airports cater for flights from other EU States, so the prices you pay in the airports are all Tax-Paid, even though they are sometimes described as Tax Free (discounted).

But, local prices for spirits, wines and beers are quite low in Spain which means they will almost certainly be cheaper than many northern european countries. Duty Free cigarettes, tobaccos or cigars is a misnoma for those travelling to or from EU countries, they are all sold at Tax-Paid prices often still cheaper than at home.

If you arrive from a non-EU Territory, like Norway or Russia, you can buy at Duty Free prices only when you depart, not when you arrive. On arrival, you must pay the Tax-Paid pricing, but very few airports sell tobacco on arrival, only alcohol, perfumes, food or gifts. Tobacco sales in Spain are now highly restricted and only sold by licenced shops known as Estancos. Most Spanish Duty Free retailers have a licence to sell cigarettes on departure, but not on arrival. Airlines flying routes between EU Countries do not sell cigarettes on board their flights and usually only liquors for consumption, not in Litre bottles.

So when you hear the phrase 'Duty Free Shopping' for travel to Spain or other EU countries, this is not correct in the strict sense. 'Tax Free' refers to the VAT (IVA/TBW/GSM) sales tax, which is levied on products like cosmetics, watches, sunglasses etc. Retailers often discount these product ranges and sell them at the same price to everyone, regardless of your destination. This practice was introduced over 10 years ago when the EU Commission abolished duty free shopping.

The simple solution is to ensure you compare prices before you travel and as more retailers go online, it becomes easier to check. Where available, we show links to all the stores and you can use our global duty free shopping search in the box above, just 'go' to find them.

If you have visited Spain as a tourist and done some shopping during your stay, you can claim a refund for the VAT that you have paid for the products. To get a VAT refund, you should get a tax refund form from the shop during your purchase. There are two types of tax refund forms you may get during shopping in Spain: tax-free forms and DIVA.

Regular tax-free forms are provided by the shops upon request. If the product you have bought is above 100€, you should ask the shop assistant to prepare a DIVA for you. The DIVA system was developed by the Spanish Tax Agency to allow for the digital stamping of proof of departure for tax-free claims. DIVA is the electronic VAT refund procedure and it streamlines the tax refund process as it works integrated with the Spanish Tax Agency database. The shop assistant will ask for your passport or passport number, name, surname, and country information. They will add all this information to the DIVA.

There are some items you need to get a tax refund at the airport. These are;

  • Your passport,
  • DIVA / Tax-free form
  • Travel documents / Your boarding pass
  • Products you have bought

If you want to get tax refunds at the airport, it is advised to get there 30 minutes before the flight. If you have a regular tax-free form, you should go to the tax-free office and ask the police to approve the form before you drop your luggage. They will ask you to fill out a form. The police may want to see the products you bought, so the products should be easily accessible.

If you have an electronic tax refund form (DIVA), you should go to a DIVA kiosk and scan the DIVA barcode to the barcode reader. After the approval of your tax refund, you should pass the security control and go to the tax-free office to get your tax refund. Here, you can get your VAT refund by showing your approved tax form to the officer. You can also send the invoices after the approval to the shops where you have bought the goods. In this case, the shop will refund the VAT you have paid for the goods.

  • If your next destination is another European Union country, you cannot reclaim VAT in Spain. You must reclaim your VAT refund in the last airport before leaving the European Union.
  • The main VAT rate is 21%, however, 4% and 10% can be applied for certain products.

  • You must leave the European Union within 3 months to get the VAT refund.
  • VAT refund can be received only for personal purchases, business purchases are not eligible for a VAT refund.

  • Present the validated Tax Free forms and get your refund
  • Standard refund
  • If you haven't received your refund at our Refund Point, provide your payment details on the Tax Free form, get Customs validation and return the Tax Free form by post using Planet prepaid envelope. You can also leave your Tax Free form in one of our Planet drop boxes.

What other refund options are available?

  • Before leaving the EU from Spain you may get your refund prior to export validation
  • To take advantage of this refund method the spend must be above 150 EUR per Tax Free form
  • If you received the Tax Free refund before your departure, you must get your Tax Free Form Customs approved within 21 days. Otherwise your credit card used for guarantee will get charged as agreement confirmed.
  • At the airport, please allow enough time for Customs approval process before your flight departs.
  • Make sure the goods are sealed and unused.
  • If you are a resident of the Canary Islands, Ceuta or Melilla your Tax Free form can be duly export validated by the respective Customs, previous payment of the IGIC Tax in Canary Islands and the IPSI Tax in the case of Ceuta and Melilla.
  • If you are departing a Spanish airport but changing flights at another EU airport, and if the goods you are exporting are to be checked through to a destination outside the EU, go to Customs at the Spanish airport and your Tax Free form will be export validated as if you were at the EU departure point.
  • In smaller airports, there may be no Customs Official present, in this case, look for the Customs deposit box and instructions.
