How to cancel family visit visa in Saudi Arabia?

Sometimes, we accidentally enter the wrong information while filling out the family visit visa application. In such a scenario, you must cancel a single or multiple family visit visa and apply for a new one in Saudi Arabia.

Cancel Visit Visa before Chamber

If you have just  applied for a family visit visa and found out that there is a mistake in the application, there is  no need to cancel it if the visa has not yet been submitted to the Chamber of Commerce for ratification.

You can file a new application and submit it to the Chamber of Commerce for ratification.

Cancel Visit Visa after Chamber

If the family visit visa is already been su bmitted to COC in Saudi Arabia, you need to do the following to cancel it;

  • Wait for MOFA to issue the visa.
  • Check the family visit visa status here.
  • Once the visa is issued, you can follow the below process to cancel it.

Auto Cancellation

There are two ways of canceling the family visit visa;

  • Wait for the visa expiry i.e. 90 days.
  • Cancel the Visa following the procedure explained below.

If you make another application without canceling the current visa, your application will be rejected. 

Log in to Nafath

To cancel an already issued family visit visa;

  • Open this website https://visa.mofa.gov.sa/Account/
  • Click on the “ Login ” button.
  • Enter your Iqama Number .
  • Approve the Nafath access .

Request for Cancellation

After this, the MOFA website will show you four options;

  • Scroll down and click on “ Inquiries & Suggestions “.
  • Click on “ Add New Inquiry or Suggestion “.
  • Type: Visa Number .
  • Enter the Visa Number (explained below).
  • Details: Please cancel the visa .

Make sure you enter the number of the visa already issued by MOFA. Some people enter the application number instead of the visa number, which leads to problems later on.

Check Cancellation Status

MOFA will cancel the family visit visa within seven days of request. When you do not find any application while checking your family visit visa status, your visa has been canceled by MOFA.

Cancel Visit Visa after stamping

You need to cancel the family visit visa already stamped on your passport or issued by the Saudi Embassy in the following cases;

  • Applying for a new family visit visa.
  • Applying for a permanent family visa .
  • Applying for a work visa.

Requirements

You need a letter from your employer requesting the Saudi Embassy to cancel the visa. The format of the letter has been given below. The letter must be;

  • Stamped by the Chamber of Commerce .
  • Attested by the MOFA .

Now he wants to bring his family on a permanent family visa (or family visit visa). However, the new visa cannot be stamped unless the old visa is cancelled.

Therefore, it is kindly requested to cancel old stamp visa and issue new visa.

  • Names of family members along with visa numbers and passport numbers.

(U) Regulations no longer distinguish between invalidation and revocation in cases when it is determined that the bearer of a visa is ineligible.  The visa should be revoked in accordance with INA 221(i), 22 CFR 41.122 and this subchapter.

9 FAM 403.11-3  (U) When to Revoke a Visa

9 FAM 403.11-3(A)  (U) When You May Revoke Visas

(U) There are four circumstances under which you may revoke a visa:

(1)  Unavailable

(3)  (U) The visa has been physically removed from the passport in which it was issued; or

(4)  (U) The individual is subject to an IDENT Watchlist record in System Messages for an arrest or conviction of driving under the influence, driving while intoxicated, or similar arrests/convictions (DUI) that occurred within the previous five years, pursuant to 9 FAM 403.11-5(B) paragraph c, below.

9 FAM 403.11-3(B)  (U) When You May Not Revoke A Visa

(CT:VISA-1463;   02-01-2022)

a. (U) You do not have the authority to revoke a visa based on a suspected ineligibility or based on derogatory information that is insufficient to support an ineligibility finding, other than a revocation based on driving under the influence (DUI).  A consular revocation must be based on an actual finding that the individual is ineligible for the visa.

b. (U) Under no circumstances should you revoke a visa when the individual is in the United States, or after the individual has commenced an uninterrupted journey to the United States, other than a revocation based on driving under the influence (DUI).  Outside of the DUI exception, revocations of individuals in, or en route to, the United States may only be done by the Department's Visa Office of Screening, Analysis, and Coordination (CA/VO/SAC).

9 FAM 403.11-4  (U) Revocation Procedures

9 FAM 403.11-4(A)  (U) Visa Revocations by Consular Officers

(U) Although the decision to revoke a visa is a discretionary one, you should not use this authority arbitrarily.  When practicable, you must:

(1)  (U) Notify the individual of the intention to revoke the visa;

(2)  (U) Allow the individual the opportunity to show why the visa should not be revoked; and

(3)  (U) Request the individual to present the travel document in which the visa was issued.

9 FAM 403.11-4(A)(1)  (U) Required Procedures

a. (U) Informing Individual of Intent to Revoke Visa:

(1)  (U) You must notify the individual of the intent to revoke a visa if such notification is practicable.  The notice of intent to revoke a visa affords the individual the opportunity to demonstrate why the visa should not be revoked.  An after-the-fact notice that the visa has already been revoked is not sufficient unless prior notice of intent to revoke was not practicable.

(2)  (U) A prior notification of intent to revoke a visa would not be practicable if, for instance, you do not know the whereabouts of the individual, or if the individual's departure is believed to be imminent.  In cases where the individual can be contacted and travel is not imminent, prior notice of intent to revoke the visa is normally required, unless you have reason to believe that a notice of this type would prompt the individual to attempt immediate travel to the United States.

b. (U) Physical Cancellation of Visa:   If a decision to revoke the visa is reached after the case has been reviewed, you must print or stamp the word "REVOKED" in large block letters across the face of the visa.  You must also date and sign this action.  If you are at a post other than the one where the visa was issued, the title and location of your post should be written below the signature.

c.  (U) If the Individual Possesses Another Valid U.S. Visa:   When you have taken action to revoke a visa, you should determine whether the individual holds another current U.S. visa in the same or another passport.  You should proceed to revoke that visa as well, if the grounds for revoking the first visa apply to any other visa the individual may hold, or if independent grounds for revocation apply.  In the latter case, you must, if practicable, give the individual an opportunity to rebut or overcome that ground(s) of ineligibility.

9 FAM 403.11-4(A)(2)  (U) When to Notify Department Regarding Revocation

a. (U) If a visa is physically cancelled before the individual's departure to the United States, then there is no need to report the revocation to the Department, except in cases involving A, G, C-2, C-3, or NATO visas.

b. (U) L/CA, the Diplomatic Liaison Division (CA/VO/DO/DL), the Chief of Protocol (S/CPR), and the appropriate country desk should be promptly notified whenever any diplomatic or official visa, or any visa in the A, G, C-2, C-3, or NATO classification is revoked.

9 FAM 403.11-4(C)  (U) Revoking Visas in Sensitive Cases

9 FAM 403.11-4(C)(1)  (U) Keeping Department Informed in High Profile Cases

a. (U) You should be alert to the political, public relations, and law enforcement consequences that can follow a visa revocation and should work with the Department to ensure that all legally available options are fully and properly assessed.  The revocation of the visa of a public official or prominent local or international person can have immediate and long-term repercussions on our political relationships with foreign powers and on our public diplomacy goals in a foreign state.  The visa laws must be applied to such persons like any others, recognizing that certain visa categories, particularly A’s and G's, are not subject to the same standards of ineligibility as others. Hasty action, however, must be avoided in such high-profile visa cases and you should seek the Department’s guidance before any visa revocation unless unusual and exigent circumstances prevent such a consultation.  Consultation both within the mission and with the Department may result in a decision that the Department, rather than the consular officer, should undertake the revocation, since Department revocations pursuant to the Secretary's revocation authority provide more flexibility in managing the relevant issues.

b. (U) When to Consult with the Department:

(1)  (U) You are responsible for keeping the Department (CA/VO/SAC, CA/VO/F, L/CA, and the appropriate country desk) informed of visa actions that may affect our relations with foreign states or our public diplomacy, or that may affect or impede ongoing or potential investigations and prosecutions by U.S. and other cooperating foreign law enforcement agencies.

(2)  (U) This is particularly true when you use the power granted under INA 221(i) as implemented in 22 CFR 41.122 and this section, to revoke the visas of officials of foreign governments, prominent public figures, and subjects or potential subjects of U.S. and foreign criminal investigations.

(3)  (U) In such cases, you should seek the Department's guidance before any visa revocation unless unusual and exigent circumstances prevent such a consultation.  In the rare cases in which advance consultation is not possible, you should inform the Department immediately after the revocation.

9 FAM 403.11-4(C)(2)  (U) Diplomatic and Official Visas

(U) You must keep in mind that most A, G, C-2, C-3, and North Atlantic Treaty Organization (NATO) visa categories are exempt from most INA 212(a) ineligibility provisions per 22 CFR 41.21(d).  Precipitant action must be avoided in cases involving foreign government officials and other prominent public figures.  Consultations at post and with the Department might result in the decision that the Department, rather than the consular officer, should undertake the revocation.  The Department's revocation authority provides more flexibility in managing relevant issues.  For example, Department revocations may be undertaken prudentially, rather than based on a specific finding of ineligibility and are not subject to the 22 CFR 41.122 requirement with respect to notification to the individual.

9 FAM 403.11-4(C)(3)  (U) When Revocation Subject is Subject of Criminal Investigation

a. (U) In cases in which the individual whose visa is revocable is also the subject of a criminal investigation involving U.S. law enforcement agencies, action without prior Department consultation and coordination could:

(1)  (U) Jeopardize an ongoing investigation;

(2)  (U) Prejudice an intended prosecution;

(3)  (U) Preclude apprehension of the subject in the United States;

(4)  (U) Put informants at risk; or

(5)  (U) Damage cooperative law enforcement relationships with foreign police agencies.

c.  (U) In deciding what cases to report in advance to the Department, posts should err on the side of prudence.  It is always better to report cases requiring no Department action rather than having to inform the Department after the fact in a case that has adverse consequences for U.S. law enforcement or diplomatic interests.  Posts should contact CA/VO/SAC.  Posts may wish to notify other functional bureaus, as appropriate.

9 FAM 403.11-5  (U) Revocation of Visas by the Department

a. (U) When the Department revokes a visa, when possible, a revocation notice will be sent to the consular section by email furnishing a point of contact in the Visa Office.  You must follow the instructions in the revocation notice.

b. (U) Although the Department is not required to notify an individual of a revocation done pursuant to the Secretary's discretionary authority, you should do so unless instructed otherwise, especially in cases where the revoked visa was issued to a government official.  

9 FAM 403.11-5(A)  (U) Notice to Department of Presence in United States

b. (U) Upon receipt of your report, the Department will decide whether the visa should be revoked.  Alternatively, the Department may inform DHS of the data submitted and give DHS an opportunity to initiate proceedings under the pertinent provisions of INA 237.  If the latter course is followed, the Department will request that DHS advise the Department of the individual's date of departure and destination, so that, after the individual's departure from the United States, the visa may be physically canceled.   

9 FAM 403.11-5(B)  (U) Prudential Revocations

a. (U) Although you generally may revoke a visa only if the individual is ineligible under INA 212(a), or INA 214(b), or is no longer entitled to the visa classification, the Department may revoke a visa if an ineligibility or lack of entitlement is suspected, when an individual would not meet requirements for admission, or in other situations where warranted.  This is known as a “prudential revocation.”  In addition to the conditions described in 9 FAM 403.11-5(A) above, the Department may revoke a visa when it receives derogatory information directly from another U.S. Government agency, including a member of the intelligence or law enforcement community.  These requests are reviewed by the Visa Office’s revocations team in CA/VO/SAC/RC, which forwards an electronic memo requesting revocation to a duly authorized official in the Visa Office, along with a summary of the available intelligence and/or background information and any other relevant documentation.  When prudential revocation is approved, the subject’s name is entered into CLASS, the visa case status is updated to "Revoke", and the revocation is communicated within the Department and to other agencies by the following means:

c.  (U) Prudential Revocation for Driving Under the Influence:   Either the consular section or the Department has the authority to prudentially revoke a visa based on a potential INA 212(a)(1)(A) ineligibility when an IDENT Watchlist Record  appears in System Messages for a CJIS Search of US-VISIT or a CJIS Search of OBIM record.   Before doing so, you must re-send the fingerprints to NGI to obtain a RAP sheet for an arrest or conviction of driving under the influence, driving while intoxicated, or similar arrests/convictions (DUI) that occurred within the previous five years.  This does not apply when the arrest has already been addressed within the context of a visa application; i.e., the individual has been through the panel physician's assessment due to the arrest.  This does not apply to other alcohol related arrests such as public intoxication that do not involve the operation of a vehicle.  Unlike other prudential revocations, you do not need to refer the case to the Department but can prudentially revoke on your own authority.  You should process the revocation from the Spoil tab NIV and add P1A3 and VRVK lookouts from the Refusal window.

9 FAM 403.11-6  (U) Reconsideration of Revocations

9 FAM 403.11-7  (U) Actions by DHS

9 FAM 403.11-7(A)  (U) Cancellation of Visas by Immigration Officers Under 22 CFR 41.122(e)

a. (U) When a visa is canceled by a DHS officer, one of the following notations will normally be entered in the individual’s passport:

(1)  (U) Canceled.  Adjusted;

(2)  (U) Canceled.  Excluded. DHS (Office) (Date);

(3)  (U) Canceled.  Application withdrawn. DHS (Office) (Date);

(4)  (U) Canceled.  Final order of deportation/voluntary departure entered DHS (Office) (Date) Canceled.  Departure required.  DHS (Office) (Date);

(5)  (U) Canceled.  Waiver revoked. DHS (Office) (Date); and

(6)  (U) Canceled.  Presented by impostor.  DHS (Office) (Date).

b. (U) Except when a visa is canceled after the individual’s status has been adjusted to that of a permanent resident, DHS will inform the consular section that issued the visa of the cancellation action.  Form I-275, Withdrawal of Application/Consular Notification, will be used to inform consular officers at the issuing office of the cancellation action.  Form I-275 and any other attached forms should not be released to individuals or their representatives.

9 FAM 403.11-7(B)  (U) Voidance of Counterfeit Visas

(U) When DHS has determined through examination that a visa has been altered or is counterfeit, it will void the visa by entering one of the following notations on the visa page, together with the action officer’s signature, title, and office location:

(1)  (U) Counterfeit visa per testimony of individual (file number); or

(2)  (U) Counterfeit visa per telecon, letter, e-mail from U.S. Embassy (U.S. Consul).

U.S. Visa Overstay and INA 222(g) -  Visa Cancellation

When a person enters the U.S. on a nonimmigrant visa, the authorized stay is usually mentioned in Form I-94, which can be downloaded from the CBP website and/or found in the passport. If the person stays in the U.S. past the authorized stay duration, the nonimmigrant visa will be rendered void, according to section 222(g) of The Immigration and Nationality Act (INA). Except in the cases of “extraordinary circumstances”, as determined by the Department of State, such person will have to apply for a new nonimmigrant visa in his/her country of nationality before being admitted again in the United States.

In cases when section 222(g) applies, your visa will not be physically canceled immediately. However, when an immigration officer encounters an alien in possession of a nonimmigrant visa that has become void automatically under 222(g), the officer must physically cancel the visa.

Removal and Bar

Once the person has fallen out of valid nonimmigrant status, he/she may be subject to removal from the U.S. Additionally, such alien may be accruing an unlawful presence in the U.S. that counts toward the 3- or 10-year bar of inadmissibility.

Two Nonimmigrant Visas

If the alien has two valid nonimmigrant visas and has to overstay on one of them, only the visa under which he/she overstayed will be voided under 222(g). The other nonimmigrant visa would still remain valid.

Waiver at the Border

Individuals whose visa was canceled under 222(g) may apply for admission at the U.S. border without a new visa by seeking a waiver under section 212(d)(4)(A) of the INA. Such waivers will be considered on a case-by-case basis and will only be granted for an unforeseen emergency. If the waiver is declined, the alien will be subject to expedited removal.

Not Applicable

As section 222(g) only applies to overstays on a nonimmigrant visa, there are many scenarios in which 222(g) is not applicable:

  • Entered the U.S. on the Visa Waiver Program
  • Entered the U.S. on advance parole
  • Entered the U.S. without inspection (illegally)
  • Entered the U.S. on a diplomatic visa
  • Entered the U.S. through any other means
  • Admitted from Canada or Mexico with an I-68 or DSP-150 Border Crossing Card, or any other Canadian or Mexican entrants to the U.S. who were not issued Form I-94 (and who were not subsequently found to be out of status by USCIS or an immigration judge)
  • Those who could not physically depart the U.S. because they were in the custody of law enforcement, such as in prison, at that time

Admitted for the Duration of Status

While tourists (for example) entering the U.S. would be admitted until a specified date, several other categories of nonimmigrants (students, exchange visitors, media representatives, diplomat visa holders, etc.) would be admitted for the duration of status (D/S).

For those admitted for the duration of status, section 222(g) would be applicable if:

  • USCIS finds a status violation while adjudicating a request for an immigration benefit; or
  • An Immigration Judge finds a status violation in proceedings against the alien.

If the nonimmigrant is admitted for duration status and files for an extension or change of status, 222(g) will apply only if the denial was because of a status violation.

Admitted Until a Specific Date

If a nonimmigrant is admitted into the U.S. until a specific date and departs before that date, section 222(g) would generally not apply unless the USCIS or an Immigration Judge formally finds a status violation before the alien’s departure.

If a nonimmigrant admitted until a specific date files for an extension or change of status and remains in the U.S. after the date on Form I-94, there are different scenarios:

  • If the application is subsequently approved, he/she will not be subject to 222(g).
  • If the application is subsequently denied, he/she will be subject to 222(g), irrespective of the reasons for the denial.
  • If the alien leaves the U.S. after the Form I-94 date while the application is pending, section 222(g) will not apply, irrespective of whether the application is later approved or denied. However, if the application is found to be frivolous, section 222(g) will apply.

If the alien files a late application for extension or change of status and USCIS still accepts it, 222(g) will not apply if the application is approved.

Generally, if you want to visit ( and not live in ) the United States you must first obtain a visitor visa . Travelers from certain countries may be exempt from this requirement. For more information, please see the U.S. Department of State website .

If you want to travel to the United States for reasons other than business or pleasure, you must apply for a visa in the appropriate category. Extending Your Visit

If Customs and Border Protection (CBP)  authorizes your admission to the United States at the designated port of entry, you will receive a stamped Form I-94, Record of Arrival-Departure . If you wish to stay beyond the time indicated on the Form I-94, you may apply for an extension by filing Form I-539, Application to Extend/Change Nonimmigrant Status , with USCIS.

If You Lose Form I-94

You may apply for a replacement Form I-94 by filing a Form I-102, Application for Replacement/Initial Nonimmigrant Arrival/Departure Record .

Temporary residents: Cancellation of a temporary resident visa

This section contains policy, procedures and guidance used by IRCC staff. It is posted on the department’s website as a courtesy to stakeholders.

In cases where the officer determines that the visa was issued due to fraud or misrepresentation, the officer should advise the person, in writing, of their concern stating that the visa is invalid and that the passport with visa should be returned to the visa office. Once the visa officer has requested the return of the visa the person should be called  for interview to cancel the visa and to find the person inadmissible for misrepresentation under A40.

The letter should include a warning to the person that POEs in Canada have been advised the visa is invalid and they will be not be admitted to Canada.

Enter a note in CAIPS/GCMS explaining the circumstances and reasons for cancelling the visa. If the officer cancelling the visa does not work in the office that issued the visa, an e-mail providing complete details will need to be forwarded to the issuing visa office in order that appropriate notes may be entered into CAIPS/GCMS. The officer should also make an NCB entry in FOSS providing complete details to ensure information is made available to border services officiers.

If the individual enters Canada, inland immigration officers may initiate removal proceedings through an A44 report alleging that the person is inadmissible for misrepresentation under A40. (This approach is also open to officers at the POE, particularly in situations where the holder has been issued a multiple-entry visa.)

Travel Without a Visa

Citizens of Canada and Bermuda

Generally, a citizen of a foreign country who wishes to travel to the United States must first obtain a visa, either a nonimmigrant visa for a temporary stay, or an immigrant visa for permanent residence. Visitor visas are nonimmigrant visas for persons who want to enter the United States temporarily for business (B-1 visa), for tourism (B-2 visa), or for a combination of both purposes (B-1/B-2 visa).

Here are some examples of activities permitted with a visitor visa:

Business (B-1)

  • Consult with business associates
  • Attend a scientific, educational, professional, or business convention or conference
  • Settle an estate
  • Negotiate a contract

Tourism (B-2)

  • Vacation (holiday)
  • Visit with friends or relatives
  • Medical treatment
  • Participation in social events hosted by fraternal, social, or service organizations
  • Participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating
  • Enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation)

Travel Purposes Not Permitted On Visitor Visas

These are some examples of activities that require different categories of visas and cannot be done while on a visitor visa:

  • Paid performances, or any professional performance before a paying audience
  • Arrival as a crewmember on a ship or aircraft
  • Work as foreign press, in radio, film, print journalism, or other information media
  • Permanent residence in the United States

Birth tourism (travel for the primary purpose of giving birth in the United States to obtain U.S. citizenship for their child) is not permissible on a visitor visa.

How to Apply

There are several steps to apply for a visa. The order of these steps and how you complete them may vary by U.S. Embassy or Consulate. Please consult the instructions on the  U.S. Embassy or Consulate website .

Complete the Online Visa Application

  • Online Nonimmigrant Visa Application, Form DS-160 – Learn more about completing the DS-160 . You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. Your photo must meet the Photograph Requirements .

Schedule an Interview

Interviews are generally required for visa applicants with certain limited exceptions below. Consular officers may require an interview of any visa applicant.

You should generally schedule an appointment for your visa interview at the  U.S. Embassy or Consulate  in the country where you live. You may schedule your interview at another U.S. Embassy or Consulate where you will be present but aware that in some cases it may be more difficult to demostrate your qualifications for a visa outside of the country where you live.

Wait times for interview appointments vary by location, season, and visa category, so you should apply for your visa early. Review the interview wait time for the location where you will apply:

Gather Required Documentation

Gather and prepare the following required documents before your visa interview:

  • Passport valid for travel to the United States – Your passport must be valid for at least six months beyond your period of stay in the United States (unless exempt by country-specific agreements ). Each individual who needs a visa must submit a separate application, including any family members listed in your passport.
  • Nonimmigrant Visa Application, Form DS-160 confirmation page.
  • Application fee payment receipt, if you are required to pay before your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. If the photo upload fails, you must bring one printed photo in the format explained in the Photograph Requirements .

Additional Documentation May Be Required

Review the instructions for how to apply for a visa on the website of the U.S. Embassy or Consulate where you will apply. Additional documents may be requested to establish if you are qualified. For example, additional requested documents may include evidence of:

  • The purpose of your trip,
  • Your intent to depart the United States after your trip, and/or
  • Your ability to pay all costs of the trip.   

Evidence of your employment and/or your family ties may be sufficient to show the purpose of your trip and your intent to return to your home country. If you cannot cover all the costs for your trip, you may show evidence that another person will cover some or all costs for your trip.

Note:  Visa applicants must qualify based on their ties abroad/to their home country, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa.

Attend Your Visa Interview

A consular officer will interview you to determine whether you are qualified to receive a visitor visa. You must establish that you meet the requirements under U.S. law to receive a visa.  Ink-free, digital fingerprint scans are taken as part of the application process. They are usually taken during your interview, but this varies based on location.

After your visa interview, the consular officer may determine that your application requires further  administrative processing .  The consular officer will inform you if this required.

After the visa is approved, you may need to pay a visa issuance fee (if applicable to your nationality), and make arrangements for the return of the passport and visa to you.  Review the  visa processing times  to learn more.

Entering the United States

A visa allows a foreign citizen to travel to a U.S. port-of-entry (generally an airport) and request permission to enter the United States. A visa does not guarantee entry into the United States. The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States. If you are allowed to enter the United States, the CBP official will provide an admission stamp or a paper Form I-94, Arrival/Departure Record. Learn more about admissions and entry requirements, restrictions about bringing food, agricultural products, and other restricted/prohibited goods, and more by reviewing the CBP website .

Extending Your Stay

See  Extend Your Stay  on the U.S. Citizenship and Immigration Services (USCIS) website to learn about requesting to extend your stay beyond the date indicated on your admission stamp or paper Form I-94. 

Failure to depart the United States on time will result in being  out of status . Under U.S. law, visas of individuals who are out of status are automatically voided ( Section 222(g) of the Immigration and Nationality Act ).  Any multiple entry visa that was voided due to being out of status will not be valid for future entries into the United States.

Change of Status

If your plans change while in the United States (for example, you marry a U.S. citizen or receive an offer of employment), you may be able to request a change in your nonimmigrant status to another category through U.S. Citizenship and Immigration Services (USCIS). While you are in the United States, receiving a change of status from USCIS does not require you to apply for a new visa.  However, once you depart the United States you must apply for a new visa at a U.S. Embassy or Consulate in the appropriate category for your travel.

Additional Information

  • An individual on a visitor visa (B1/B2) is not permitted to accept employment or work in the United States.
  • There is no guarantee you will be issued a visa. Do not make final travel plans or buy tickets until you have a visa.
  • A valid U.S. visa in an expired passport is still valid. Unless canceled or revoked, a visa is valid until its expiration date. If you have a valid visa in your expired passport, do not remove it from your expired passport. You may use your valid visa in your expired passport along with a new valid passport for travel and admission to the United States. 

Travel for Medical Treatment

If you are seeking medical treatment in the United States, the consular officer may ask for further documents at your visa interview, which may include:

  • Medical diagnosis from a local physician, explaining the nature of the ailment and the reason you need treatment in the United States.
  • Letter from a physician or medical facility in the United States, stating they are willing to treat your specific ailment and detailing the projected length and cost of treatment (including doctors’ fees, hospitalization fees, and all medical-related expenses).
  • Proof that your transportation, medical, and living expenses in the United States will be paid. This may be in the form of bank or other statements of income/savings or certified copies of income tax returns (either yours or the person or organization paying for your treatment).

Visitor Visas for Personal or Domestic Employees (B-1)

You may apply for a B-1 visitor visa to work in the United States as a personal or domestic employee for your employer in limited situations. You may for a visitor visa as a domestic employee if, among other requirements, your employer is:

  • A U.S. citizen who has a permanent home or is stationed in a foreign country, but is visiting or is assigned to the United States temporarily; or
  • A foreign citizen who is in the United States on one of the following nonimmigrant visa categories:  B, E, F, H, I, J, L, M, O, P, Q or TN.

Visa Renewal

Whether you are applying for the first time or renewing your visa, you will use the same application process (please review How to Apply , above). Some applicants seeking to renew their visas in certain visa classes may be eligible for the Interview Waiver (IW) which allows qualified individuals to apply for visa renewals without being interviewed in person by a U.S. consular officer. Review the instructions on the website of the U.S. Embassy or Consulate where you will apply to determine if IW is available and if you qualify.

Do I need a visa if I have an ABTC?

Yes, you will still need a visa to travel to the United States, unless you qualify for the  Visa Waiver Program . Having an Asian-Pacific Economic Cooperation (APEC) Business Travelers Card (ABTC) does not change visa requirements, your visa status, or the visa process for travel to the United States.

How can I use my ABTC when I apply for my visa?

If you have an Asian-Pacific Economic Cooperation (APEC) Business Travelers Card (ABTC), you might be able to schedule an expedited visa interview appointment. Review the instructions for scheduling expedited appointments on the website of the  embassy or consulate  where you will apply. 

Visa Annotations for Certain Maritime Industry Workers

Certain foreign maritime workers are eligible to apply for a Transportation Worker Identification Credential (TWIC) once in the U.S. If you, as a maritime industry worker, will perform services in secure port areas, your visa must be annotated “TWIC Letter Received.” Workers whose visas are not annotated will not be permitted by the Transportation Security Administration (TSA) to apply for a TWIC.

In order for your visa to be annotated, you must obtain a letter from your employer explaining the need for a TWIC and that you are a potential TWIC applicant. See a template example of this letter. You must present this letter when you apply for the B-1 visa. You must meet all other eligibility requirements for a B-1 visa.

Misrepresentation or Fraud

Attempting to obtain a visa by the willful misrepresentation of a material fact, or fraud, may result in the permanent refusal of a visa or denial of entry into the United States.

Citizens of China

In accordance with the agreement signed between the United States and China to extend visa validity, beginning on November 29, 2016, Chinese citizens with 10-year B1, B2 or B1/B2 visas in Peoples’ Republic of China passports will be required to update their biographical and other information from their visa application via a website every two years, or upon getting a new passport or B1, B2, or B1/B2 visa, whichever occurs first.  This mechanism is called EVUS - Electronic Visa Update System.

The EVUS website is now open to the public for enrollments at www.EVUS.gov .  CBP will not collect a fee for EVUS enrollment at this time. CBP anticipates the eventual implementation of an EVUS enrollment fee, but does not have a time frame. Until the implementation of a fee, travelers can enroll in EVUS without charge.  The Department of Homeland Security, Customs and Border Protection (CBP) will keep visa holders informed of new information throughout the year. Citizens of Mexico

Citizens and permanent residents of Mexico generally must have a nonimmigrant visa or Border Crossing Card (also known as a "Laser Visa"). Cancelling your residence visa

If you a have a residence visa sponsored either by a family member or by your employer, and you decide to leave the country permanently, your residence visa must be cancelled officially.

Normally, only the sponsor can cancel your residence visa. You cannot process the application on your own.

If a company decides to cancel an employment visa of its employee, it must first approach Ministry of Human Resources and Emiratisation with an application to cancel the employee’s labour contract and labour card. The employee must also sign this application. Then, the employer should apply to ICP for visa cancellation.

The company must also cancel the work permit. For this, it must submit a letter signed by the employee stating that he has already received all his wages and end of services benefits to Ministry of Human Resources and Emiratisation.

An individual sponsoring his/her spouse, children and other dependents must cancel the dependents’ visas before he cancels his/her own.

How to cancel your residence visa?

There are two ways to cancel your visa. You can do it either through a registered typing centre or online.

The sponsor may visit any typing office registered by ICP in the respective emirate. The typing office will fill the cancellation form on your behalf and process it online through ICP.

Alternatively, the sponsor may process the cancellation  online through the ICP website or the ICP application Google Play or App Store .

Many people wonder why a CBP agent cancels a visa and what you can do to get it back. Well here in this blog we will explain everything you need to know to avoid any situation that may jeopardize your right to enter the United States through a tourist visa.  

What are the reasons for cancellation of an American visa?

FIRST , it is necessary to know the reasons why a U.S. Customs and Border Protection (CBP) agent can cancel any visa if they find any anomaly at the time of your entry or exit of the United States, since the solution you may have depends on it.

If any of the following events occur, your visa may be cancelled and in many cases with a permanent penalty:

  • Staying in the U.S. longer than allowed. Remember that you can stay in the U.S. for up to 30 days if you are visiting the border area, or for the time indicated on the entry stamp affixed by the official.
  • Giving false information to a Customs and Border Protection (CBP) officer.
  • Using the SENTRI lane without being authorized to do so.
  • Committing a crime in the U.S.
  • Misplacing your U.S. visa and failing to report it to the proper authorities.
  • Traveling to the U.S. with prohibited items such as weapons, explosives, drugs or without declaring sums greater than $10,000 dollars.
  • Claiming to be a U.S. citizen without being a U.S. citizen or lending your visa to someone else.
  • Using the tourist visa for lucrative purposes such as working or buying merchandise for resale.
  • Helping people cross into the U.S. who do not have the proper immigration documentation.
  • Studying on a tourist visa
  • If you have a pending or unresolved legal proceeding before a federal, state or local court in the U.S.
  • Enrolling your children in U.S. schools on tourist visas.
  • For pregnant women, giving birth in the U.S. without paying medical bills, as well as accepting Medicare assistance.
  • Not paying traffic tickets, driving without a license, license plates or insurance.

For any of these offenses committed, the punishment of cancellation can range from 3, 5, 10 years of not being able to return to the United States or even up to a permanent bar.

Can I apply for a waiver to get my tourist visa back?

Probably. The first thing to do will be to find out the real reason why CBP cancelled the visa.

Once you have identified the problem, you will have to validate if you are ELIGIBLE for a waiver, since not all persons or crimes are eligible for a waiver. In many instances a person who is not eligible for a waiver will have to wait the necessary punishment time to reapply for a visa. CBP is the only one who can decide whether or not to reinstate your visa.

If you do not know whether or not you are eligible for a waiver to reinstate a visa, we recommend that you first serve the punishment you were given, then apply for a visa application at the American embassy in your home country and upon being interviewed by a consular officer, state that you need their advice to see if you are eligible for a waiver. In addition, it is recommended that you demonstrate permanent roots in your home country such as: formal work, family, property titles, bank accounts, academic degrees, etc. You can also demonstrate humanitarian reasons, health reasons, or any other reason you have that does not signify an overstay or unlawful stay.  

What if my visa has a CWOP stamp?

There are occasions when the customs officer cancels a visa but includes the acronym CWOP “Cancelled without prejudice”. This means that the cancellation of the visa will NOT have any negative effect on the visa renewal application in the future.

The reasons for receiving a CWOP may be:

  • That the visa has expired.
  • It has some data error either in the name, date of birth or any other error of administrative or paperwork origin.

If you receive a stamp or inscription like the image above, you will simply have to renew or apply for a new visa, since the current one was CANCELLED without prejudice.

  • Select “English” on the top left corner of the page.
  • Choose the “Request a Family Visit “option.
  • Submit the initially required information.
  • Reach the fourth step, called “Visitor Information.” 
  • In the “العنوان” section of the visitor’s information, write the Visa number that you need to cancel instead of your office address.
  • Complete the form and submit it.

Cancel your application.

You can only cancel (withdraw) an application for a visa, visa extension or citizenship if you’re still waiting for a decision. 

What you’ll be refunded depends on what stage your application is at when you cancel.

Before you cancel

You may not need to cancel your application if:

  • you only want to ask for your passport and other documents to be returned
  • you applied from inside the UK and now want to apply for a different visa instead

If you cancel your application:

  • you cannot stop the cancellation once it’s been received by UK Visas and Immigration ( UKVI )
  • you may lose your permission to stay here if you’re in the UK

How to cancel your application

How you cancel and the deadline for getting a refund depends on how you were told to prove your identity when you started your online application.

You would have been told either to:

  • attend an appointment to provide your biometrics (fingerprints and photo) and identity document in person
  • use the ‘UK Immigration: ID Check’ smartphone app to upload your photo and scan your identity document

Follow the process for appointments even if you were later told you did not need one. For example, because you had given your fingerprints before and were told you could send your photo electronically.

If you were told to attend an appointment

If you applied within the UK, fill in the online form to withdraw your application .

If you applied outside the UK, sign in to your account using the link from your sign-up email. Go to ‘Section 6: further actions’ to cancel your application.

You’ll also need to cancel any appointments at the visa application centre.

If you used the smartphone app

You can cancel your application online.

To cancel, sign in to your account using the link from your sign-up email. Go to your dashboard and select ‘Withdraw this application’ for the application you want to cancel.
